Terms of Sale, Refunds, Returns.

Terms of sale.

By purchasing from Joe Clark Photographer, LLC (hereinafter Artist)  you, the purchaser (hereinafter Client), agree to be bound by all terms of sale, refund, and return policies. You also agree that you have read these terms, understand them, and have asked any questions for clarification on them prior to making your purchase.

Firstly Client understand that they are purchasing delicate artwork that has been prepared specifically for their order. Once Artist has prepared the file and transmitted it to the fulfilling vendor Client acknowledges that no refunds can be offered. Client understands that the artwork is intended to be framed and that Artist is not liable for any damages to artwork once it has been received by Client. In the event that Limited or Single Edition artwork is damaged in shipping Client is to immediately notify Artist who will start working on a resolution with the carrier and laboratory. Artist may choose to have evidence of destruction provided by client and the print re-issued with the same number.

Client Acknowledges that open edition artwork will be signed electronically with a watermark which will be printed by the fulfilling laboratory and that such artwork will be directly shipped to Client from the lab. Limited Editions may for convenience to Artist be signed and numbered individually but electronically as a part of the unique print file and submitted to the fulfilling lab in the same manner. This process will permit Artist to hand sign and number the digital files prior to printing so that signature and number are printed to the same archival standard as the rest of the print and varnished by the lab for protection if such service are available. Such varnishing will be noted in the product description.

Client acknowledges that Artist is constantly working in the field most of the year and that artwork that requires hand signatures can only be produced once Artist has returned to a location where they are able to process, receive, sign, and ship that artwork out. Artist is traveling by sailing vessel and may encounter significant delays in these functions. Client understands that such delays are uncontrollable and acceptable. Client agrees that any delay due to the sailing vessel’s port schedule, or availability of services, as solely determined by Artist is not a reason to request a refund for any ordered product.

Open edition, and non-art retail items which arrive damaged will be replaced upon notice from the Client by the fulfilling laboratory as soon as possible. Client agrees to submit an email to info@joeclarkphotographer.com with photos of the damaged item, shipping label,  all 6 sides of the packaging to initiate this process.

Client agrees that due to the complexities of shipping artwork, particularly larger pieces, that any monies paid for shipping will be considered a deposit towards shipping. In most cases there will be no need to collect any additional funds, however large rigid prints such as canvases and metals of certain sizes must be shipped in wooden crates. These crate fees and some shipping are included in the shipping pricing as indicated in checkout. Orders for larger items, multiple items of different print types, etc may require additional shipping costs that Client accepts responsibility for and agrees to pay to Artist. These costs are not currently calculable with the e-commerce system but will be billed at the cost incurred by Artist. In the event that Client desires to cancel their order due to these shipping costs they may do so as long as the order can be refunded from the printing vendor to Artist. Artist will make an attempt to determine shipping costs associated with orders where additional fees may be incurred and communicate with Client, this is not guaranteed.

Sales Tax: Due to recent litigation Artist may incur additional tax fees when shipping to various municipalities, these fees will be passed onto Client as determined by Artist. Client agrees to accept and pay these fees to Artist. Client also agrees that they will remedy any liability to their local municipality by paying the sales tax directly to the local municipality and state of which they receive their items within if such sales tax has not been collected to the full amount. Artist will not be held responsible for Client’s failure to pay sales or use tax to their state or local municipality.

Data sharing and contact permissions: Client agrees that Artist may contact them in regards to their order. This contact may include email, sms, and phone calls. The use of your personal information will be as guided by our privacy policy.

Editions:

Artist reserves all rights to photography, including the rights to create various editions. Each edition will be managed in the manner of which is it advertised on the product listing. Due to health challenges faced by Artist and the lack of accessibility to printing facilities most limited edition prints will be produced as needed per order. These pieces will be sequentially numbered and their inventory tracked to ensure that the number of available prints are not exceeded. Photographs previously sold in open editions may be included into future limited editions.

We have three types of editions for our prints.

Open Edition:

An open edition is a set of prints which are not numbered and may be signed by the artist or signed electronically. These prints have comprised the majority of our sales from The Gallery over the years.

Limited Edition:

In a limited edition the prints are all signed and numbered. A pre-determined number of prints will be produced per edition, however there may be multiple editions of the photograph released. For example, there may be an edition of canvas at a certain size and style, and multiple editions of matted prints based upon size. Limited editions are a great investment opportunity. All limited edition photography is printed to archival standards to ensure that you are purchasing an heirloom piece which will last the generations. These editions may have some variation between prints due to the necessary fulfillment methods mentioned above.

Single Edition:

A single edition is similar to a limited edition except in a single edition there will only ever be one edition produced. These prints are higher in value than limited or open editions and represent the highest level of investment in our artwork. Single editions may also be single print runs which are numbered 1 of 1. These are truly unique photographic prints and will never be produced again. These editions may have some variation between prints due to the necessary fulfillment methods mentioned above.

Other reproductions may exist outside of the above editions. These reproductions include publications such as non-art retail items, books of the artist’s work, artist’s proofs which are a reference for the printed editions, and gallery proofs / hors d’commerce which would be used as display items for the editions.

Why so strict?

Thank you for your interest in Joe’s photography. Our goal is to ensure that each piece finds its perfect home, and we’re thrilled that you’ve chosen to support Joe’s work.

Due to Joe’s medical condition, our family is currently living aboard Sailing Vessel Animaashi and traveling to various destinations as Joe continues to capture his unique photography. As a result, we are not operating a traditional business and are unable to offer standard return or replacement policies, nor do we have the capacity for inventory storage.
